<p>This means that Buying Property may get Easier.</p>
<p>If the Government&#8217;s proposal for amending the <a title="The Registration Act, 1908" href="http://www.vakilno1.com/bareacts/regis1908/regis.html" target="_blank">Registration Act </a> goes through , lot of stress associated with buying property will be eliminated</p>
<p>Under the amendments proposed by the rural development ministry and due to be taken up by the cabinet soon, all records of future<em> property transactions will be digitised</em> and made easily available for any potential buyer to access , reports HT</p>
<p>As of today, land records and related information are haphazardly managed and difficult to get, often resulting in buyers ending up with a property that’s already been sold to someone else.</p>
<p><span id="more-2400"></span></p>
<p>What does this  Amendment result in:</p>
<p><em>1. ownership of the Property / Land would be clearly established.</em></p>
<p><em>2. Prices at which the property changed hands, making it easier to value in years to come. </em></p>
<p><em>3. The changes,if affected,  will benefit buyers in both rural and urban areas.</em></p>
<p><em>4. Process of registration becomes more transparent and the information available to the public is more detailed and accurate</em></p>
<p>“The proposed amendments have been cleared by law minister Kapil Sibal. Now, we will seek cabinet clearance,” rural development minister Jairam Ramesh informed media</p>
<p>The amendments have been proposed as a supplementary measure to the land acquisition bill. Though the bill is expected to have more of an impact on rural areas, the supplementary measure will benefit potential buyers in cities and towns as well.</p>

				<content:encoded><![CDATA[<p><span style="color: #993300"><strong>Supreme Court directs all state govts to implement Sec 66A guidelines</strong></span></p>
<p><strong>Sec 66A guidelines</strong> has to be implemented with the approval of a senior police official before arresting any person for posting defamatory content on social networking platforms like <a title="facebook" href="http://www.facebook.com/Vakilno1com" target="_blank">Facebook</a> and <strong>Twitter</strong>, asked by SC to all state govts.</p>
<p>These guidelines were issued by the Indian Government in November 2012 and the govt had informed that this decision was taken to prevent the misuse of <strong>Sec 66A</strong>, after several incidents of the misuse of the act was reported in the country in the preceding months.<span id="more-2395"></span></p>
<p>This judgement follows a <strong>PIL</strong> (Public Interest Litigation) filed by a Delhi student challenging the Section 66A of the <a title="IT ACT" href="http://www.vakilno1.com/bareacts/informationtechnologyact/informationtechnologyact.html" target="_blank">Information Technology Act</a> in November 2012.</p>
<p>Singhal had filed this plea after the arrests of two girls from Palghar, Maharashtra for posting an update on<a title="facebook" href="http://www.facebook.com/Vakilno1com" target="_blank"> Facebook</a> and liking that status update in November 2012.</p>
<p>In the student’s plea, Singhal had noted that Sec 66A was vague and therefore may lead to unprovoked abuse, which will violate the right of speech and equality provided by the Constitution of India.</p>

<p>The <strong>Supreme Court of India</strong> today on Friday stayed all proceedings filed by Sahara group on pleas and on Subrata Roy against refunding <strong>Rs 24,000 crore</strong> to the depositors.</p>
<p>Justices K S Radhakrishnan and J S Khehar issued notice to them on SEBI&#8217;s plea seeking transfer of all cases filed by them in <strong>Securities Appellate Tribunal and Allahabad High Court</strong> to Supreme Court.<span id="more-2391"></span></p>
<p>Appearing for SEBI, senior counsel Arvind Datar submitted that &#8216;shocking things&#8217; are in CD which was supplied by Sahara Group on investors who had put in their money in its two companies &#8211; <strong>Sahara India Real Estate Corporation (SIREC)</strong> and <strong>Sahara Housing Investment Corporation (SHIC).</strong></p>
<p>Senior advocate Ram Jethmalani and advocate Keshav Mohan, appearing for Sahara group, on the other hand, submitted that Sebi is wasting their time and also said that there is serious atmosphere of prejudice prevalent against it as SEBI is leaking information to media on investors.</p>
<p>The bench was hearing a contempt plea filed by SEBI against the Group for not complying apex court&#8217;s order passed on August 31, 2012 for depositing Rs 24,000 crore to SEBI.</p>

				<content:encoded><![CDATA[<h4><span style="color: #993300"><strong>Supreme Court will be deciding a very complex issue &#8230; Whether child should stay with foster parents or biological parents?</strong></span></h4>
<p><strong>Supreme Court</strong> will decide the complex issue whether foster parents or biological parents entitled to child custody.</p>
<p>The <strong>apex court</strong> has agreed to hear a plea of biological parents seeking custody of their child who was allowed by the <strong>Delhi High Court</strong> to live with his uncle and aunt with whom he has been living for the <strong>last 10 years.</strong><span id="more-2384"></span></p>
<p>A bench of Justice issued notice to the foster parents on the plea of biological parents seeking custody of the 12-year old boy. The maternal aunt and her husband took the child as they had three daughters and did not have son. They promised to take care of him.</p>
<p>The child remained with them for nearly ten years and used to visit his biological parents on weekends and on holidays. The biological parents then took the child back in May 2012.</p>

<p>The <strong>Punjab and Haryana High Court</strong> has dismissed the petitions filed by farmers against the <em>2,800 MW atomic power project plant</em> in Gorakhpur village in Haryana.<span id="more-2379"></span></p>
<p>The development is significant, as a large number of petitioners of Gorakhpur village, whose land was acquired by the government for setting up the plant, had moved the Punjab and Haryana high court demanding quashing of government notifications, whereby the process of acquiring around 1,500 acre land of Gorakhpur and adjoining villages of Fatehabad district was initiated.</p>
<p>In their petition, filed in January 2012, the farmers had also sought directions to shift the site of project towards barren or less fertile land, which is in abundance in the adjoining villages of other districts.</p>

<p>On <strong>May 16, 2013</strong> Sanjay Dutt finally surrendered to serve the remaining <strong>three-and-a-half years</strong> of his prison term for possessing illegal arms in a case linked to the 1993 Mumbai serial blasts case, <em><a title="legal news" href="http://www.ndtv.com/article/people/sanjay-dutt-aka-munnabhai-goes-to-jail-367661" target="_blank">reports NDTV</a></em>.<span id="more-2375"></span></p>
<p>Dutt, who travelled to court with wife Manyata, sister Priya, brother-in-law Owen and director Mahesh Bhatt, couldn&#8217;t leave his car for 20 minutes.</p>
<p>However, Dutt struggled to stay calm as mikes were pushed in his face. He finally reached the courthouse at <strong>2.50pm.</strong></p>
<p>Sources said Dutt replaced his gold ornaments with red-and-yellow raksha dhaaga, which he wore around his wrist and neck. A friend said, &#8220;A puja was performed by Manyata, after which a red tilak was put on Dutt&#8217;s forehead.&#8221;</p>

The apex court, which refused to pass an order for a blanket ban on the arrest of a person for making objectionable comments on websites, said the state governments should ensure strict compliance of the Centre’s 9th January advisory which said that a person should not be arrested without taking permission from senior police officials.</p>
<p>The court&#8217;s directions on arrests under Section 66 A of the <a title="IT Act" href="www.vakilno1.com/bareacts/informationtechnologyact/informationtechnologyact.html " target="_blank">IT Act</a> came during a hearing on a plea that challenged the arrest of a human rights activist from Andhra Pradesh who was apprehended last week for posting allegedly defamatory comments against a Congress leader on Facebook.</p>
<p>The petitioner in the case, law student Shreya Singhal, has also challenged the validity of Section 66A and had urged that no arrests should be made under the controversial Section till the Supreme Court decides on her PIL. The court today said all states should abide by the advisory till it decides on the validity of the provision.</p>
<p>About <a title="Section 66A of Information Technology Act 2000" href="http://www.vakilno1.com/bareacts/informationtechnologyact/informationtechnologyact.html#_66_A_Punishment_for_sending_offensive_messages_through_communication_service_etc" target="_blank">Section 66A</a> of the <strong>Information Technology Act</strong> : <strong>( Introduced vide ITAA 2008)</strong><br />
Any person who sends, by means of a computer resource or a communication device,<br />
-<br />
a) any information that is grossly offensive or has menacing character; or</p>
<p>b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, or ill will, persistently makes by making use of such computer resource or a communication device,</p>
<p>c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the or igin of such messages<strong> (Inserted vide ITAA 2008)</strong> shall be punishable with imprisonment for a term which may extend to two three years and with fine.</p>
<p><strong>Explanation</strong>: For the purposes of this section, terms &#8220;Electronic mail&#8221; and &#8220;Electronic Mail Message&#8221; means a message or information created or transmitted or received on a computer, computer system, computer resource or communication device including attachments in text, image, audio, video and any other electronic record, which may be transmitted with the message]</p>

<h3><span style="color: #993300;">Don&#8217;t treat Daughter-in-law as House Maid  Daughter-in-law is Family and not Domestic Help</span></h3>
<p>Here are the Observations of the Supreme Court while sentencing Gurnaib Singh to five years imprisonment for torturing his wife, who committed suicide.</p>
<p>A daughter-in-law is to be treated as a member of the family with warmth and affection and not as a stranger …. She should not be treated as a housemaid and she cannot be &#8216;thrown out of her matrimonial home at any time&#8221;</p>
<p>SC said that a bride must be respected in her matrimonial home as it  &#8220;reflects the sensitivity of a civilised society&#8221;.<br />

SC Bench (justices K.S. Radhakrishnan and Dipak Misra)  said it was a matter of great concern that brides in several cases were being treated with total insensitivity, destroying their desire to live.</p>
<p>The SC bench added &#8220;It is a matter of grave concern and shame that brides are burned or otherwise their life-sparks are extinguished by torture, both physical and mental, because of demand of dowry and insatiable greed and sometimes, sans demand of dowry, because of cruelty and harassment meted out to the nascent brides, treating them with total insensitivity, destroying their desire to live and forcing them to commit suicide, a brutal self-humiliation of life&#8221;</p>

<p>Sanjay Dutt&#8217;s lawyer said, the actor will surrender before a <strong>TADA court</strong> on Thursday because he has withdrawn his application seeking permission to surrender before <strong>Pune’s Yerwada Jail.</strong><span id="more-2353"></span></p>
<p>53-year-old actor had filed an application before special <strong>TADA Judge GA Sanap</strong> in Mumbai seeking permission to surrender before the Yerwada jail in Pune instead of giving himself up before the special court in south Mumbai.</p>
<p>Later, the court allowed Dutt to withdraw his application.</p>
<p>Dutt, whose conviction under the <a title="arms act" href="http://www.vakilno1.com/bareacts/armsact/armsact.html" target="_blank">Arms Act</a> was upheld by the<strong> Supreme Court</strong> recently, has been asked to surrender on May 16 to serve remaining part of his punishment.</p>
<p>The actor had filed the application in the TADA court hours after the <strong>Supreme Court</strong> refused to grant him additional time to surrender for undergoing the remaining 42-month’s jail term.</p>

<p>The <strong>Supreme Court of India</strong> is annoyed with <a title="bar council of india" href="http://www.vakilno1.com/bareacts/laws/the-bar-councils-validation-of-state-laws-act-1956.html" target="_blank">Bar Council of India</a> as it is not taking any action against erring lawyers. The Court comments that Council has become<strong> &#8220;ineffective&#8221;</strong> and courts become victims because of such legal practitioners.<span id="more-2347"></span></p>
<p>The bench said that the petitioner can approach the <strong>Bar Council</strong> and lodge complaint against the lawyer who had withdrawn the petition.</p>
<p>The bench made the remarks while refusing to hear anticipatory bail plea of a Mumbai-based businessman, who moved the apex court even after his lawyer had earlier withdrawn the petition.</p>
<p><a title="bar council of india" href="http://www.vakilno1.com/bareacts/laws/the-bar-councils-validation-of-state-laws-act-1956.html" target="_blank">Bar Council of India</a> is the regulating body for practising advocates and frames rules on their professional standards and legal education in the country.</p>
